安徽省住建厅关于建立长效机制切(qie)实保障(zhang)建筑行(xing)业(ye)农民工(gong)工(gong)资支付(fu)工(gong)作的通知

为有效防止房屋建筑和市政基础设施(shi)工(gong)(gong)(gong)程(cheng)建设领(ling)域拖欠工(gong)(gong)(gong)程(cheng)款和农(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)问题发(fa)生,加强源头治(zhi)理(li),根据《保障农(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)支付(fu)条例》《安徽省建筑市场(chang)管理(li)条例》等有关(guan)规定,现就建立长效机制切实保(bao)障建筑行业农民工(gong)工(gong)资(zi)支(zhi)付工(gong)作通知如下:

一、全面落实工(gong)资支付保障制度

各级住房城乡建设主管部(bu)门要严(yan)格落实现行(xing)(xing)的保障(zhang)建筑行(xing)(xing)业农民(min)工工资支付各项管理(li)制度,采取强有(you)力的管控措施,严(yan)肃处理(li)违(wei)法违(wei)规行(xing)(xing)为。

()实名(ming)管(guan)理制度。严格(ge)实行(xing)建(jian)筑行(xing)业(ye)农(nong)民(min)工(gong)劳动用(yong)(yong)工(gong)实名(ming)制管(guan)理。施工(gong)总承包企业(ye)或分包企业(ye)要依法与所招用(yong)(yong)的(de)农(nong)民(min)工(gong)订立劳动合同,依托建(jian)筑工(gong)人实名(ming)制管(guan)理服务平(ping)台实施用(yong)(yong)工(gong)实名(ming)登(deng)记。凡未实行(xing)实名(ming)制信(xin)息登(deng)记的(de)建(jian)筑农(nong)民(min)工(gong)(包括(kuo)临(lin)时建筑劳务人员),不(bu)得进入(ru)施工(gong)现场。对实名(ming)制登(deng)记制度不(bu)落实的(de)施工(gong)总承(cheng)包企业,一经查实,责令限期改正(zheng),记录不(bu)良(liang)信(xin)用;逾期(qi)不(bu)改正的,按管理权(quan)限依(yi)(yi)法依(yi)(yi)规给予施工(gong)总承(cheng)包企(qi)业限制(zhi)承(cheng)接(jie)新工(gong)程、降低资(zi)质(zhi)等级、吊销资(zi)质(zhi)证书等处理。柔性用工(gong)管理,分(fen)岗(gang)位确定用工(gong)年龄,避免(mian)建筑行(xing)业农(nong)民(min)工(gong)超龄一刀切;超龄工人(ren)定(ding)期(qi)进(jin)行健康(kang)检查、加(jia)强安(an)全(quan)教育。施(shi)工总(zong)承(cheng)包(bao)企业、分包(bao)企业要建立用(yong)工管理台账,并保存至工程(cheng)完工(gong)且工(gong)资全部(bu)结清后至少3年。

()工(gong)资专(zhuan)用账户制(zhi)度(du)。房建(jian)和(he)市政工(gong)程建(jian)设项(xiang)目(mu)开工(gong)前,施工(gong)总承(cheng)包企(qi)业应在符合条件的商业银行(xing)开设农民工(gong)工(gong)资专(zhuan)用账户,并按监管(guan)要求规范工(gong)资专(zhuan)用账户名称。施工(gong)总承(cheng)包企(qi)业在项(xiang)目(mu)所在地有2个及以上工(gong)程项目(mu)同时在(zai)建(jian)的(de)(de),可开设(she)新的(de)(de)专用(yong)(yong)账户,也可在(zai)符合监(jian)管(guan)要(yao)求的(de)(de)情况下(xia),在(zai)已有的(de)(de)专用(yong)(yong)账户下(xia)按项目(mu)进(jin)行(xing)管(guan)理。凡(fan)未(wei)设(she)立(li)专用(yong)(yong)账户或开设(she)专用(yong)(yong)账户但未(wei)使用(yong)(yong)及专用(yong)(yong)账户资金未(wei)专项用(yong)(yong)于支付农(nong)民工(gong)工(gong)资的(de)(de),一经查实(shi),责令限期改正,记录不良信用(yong)(yong);逾(yu)期不改正的,按管理权限依(yi)法依(yi)规给(ji)予施(shi)工总承包企业限制承接新(xin)工程、降低(di)资质等级、吊(diao)销(xiao)资质证(zheng)书等处理。

()人工(gong)(gong)费(fei)(fei)(fei)分(fen)(fen)账(zhang)制度。建(jian)设(she)单位要严格落(luo)实人工(gong)(gong)费(fei)(fei)(fei)用与其他工(gong)(gong)程(cheng)款分(fen)(fen)账(zhang)管理(li)的(de)要求,按(an)照(zhao)合(he)同约(yue)定(ding)(ding)和(he)实际施(shi)(shi)工(gong)(gong)进度,按(an)月将人工(gong)(gong)费(fei)(fei)(fei)用足额拨付至本项目开设(she)的(de)农民(min)工(gong)(gong)工(gong)(gong)资专用账(zhang)户。按(an)照(zhao)施(shi)(shi)工(gong)(gong)过程(cheng)结算的(de)相关(guan)规定(ding)(ding),建(jian)设(she)单位每月拨付人工(gong)(gong)费(fei)(fei)(fei)原则上不低于当(dang)月工(gong)(gong)程(cheng)结算款的(de)20%;按照合同约定(ding)当月不具(ju)备(bei)结(jie)算和计(ji)量(liang)条(tiao)件的(de),拨付(fu)人工费(fei)原则(ze)上不低于工程造价(jia)总额六计(ji)划工期() X20%。 凡人工费(fei)分(fen)账制度(du)不(bu)落实的建(jian)设单位(wei),一经查实,责令限期改正(zheng),记录不(bu)良信用;逾期不(bu)改正(zheng)的,依(yi)法依(yi)规给予罚款等处罚;涉及(ji)政(zheng)府投资(zi)项目的建设单位(wei),除依法(fa)承担责任外(wai),及(ji)时移(yi)交(jiao)人(ren)力资(zi)源社会(hui)保障(zhang)部门和其他(ta)有(you)关部门,按照《保障(zhang)农(nong)民工工资(zi)支付条例》及(ji)相关法(fa)律、法(fa)规规定处理。

()总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye)代(dai)发(fa)制(zhi)度。房(fang)建(jian)和市政工(gong)(gong)(gong)(gong)(gong)程(cheng)建(jian)设项目实(shi)行分包(bao)(bao)(bao)企(qi)业(ye)农(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)资(zi)委托(tuo)施(shi)工(gong)(gong)(gong)(gong)(gong)总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye)代(dai)发(fa)制(zhi)度。分包(bao)(bao)(bao)企(qi)业(ye)要依托(tuo)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)(gong)人实(shi)名制(zhi)管理服(fu)务(wu)平台,按月考核农(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)作(zuo)量并编制(zhi)工(gong)(gong)(gong)(gong)(gong)资(zi)支(zhi)付表(biao),经农(nong)民工(gong)(gong)(gong)(gong)(gong)本(ben)(ben)人签字(zi)确认后,与(yu)当月工(gong)(gong)(gong)(gong)(gong)程(cheng)进度等(deng)情况一(yi)并交(jiao)施(shi)工(gong)(gong)(gong)(gong)(gong)总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye),由施(shi)工(gong)(gong)(gong)(gong)(gong)总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye)通过农(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)资(zi)专用账户(hu),直接将(jiang)(jiang)工(gong)(gong)(gong)(gong)(gong)资(zi)支(zhi)付到农(nong)民工(gong)(gong)(gong)(gong)(gong)本(ben)(ben)人的(de)社(she)会保障卡(ka)或银行卡(ka),任何(he)单(dan)位及个人不得以任何(he)理由扣押(ya)或变相扣押(ya)。严禁施(shi)工(gong)(gong)(gong)(gong)(gong)总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye)将(jiang)(jiang)工(gong)(gong)(gong)(gong)(gong)资(zi)款(kuan)打入分包(bao)(bao)(bao)企(qi)业(ye)账户(hu)。对违反(fan)代(dai)发(fa)制(zhi)度的(de)总(zong)承(cheng)包(bao)(bao)(bao)企(qi)业(ye),一(yi)经查实(shi),贵令(ling)限期改正,记录不良信(xin)用;逾(yu)期不改(gai)正的,按管理权(quan)限依法(fa)依规给予施工(gong)总承包企业限制承接(jie)新(xin)工(gong)程、降低资质等级、吊销资质证书等处罚(fa)。

(五(wu))工(gong)(gong)(gong)资(zi)(zi)保(bao)(bao)(bao)证金制度。房建和市政工(gong)(gong)(gong)程建设项目开(kai)工(gong)(gong)(gong)前,施工(gong)(gong)(gong)总承包(bao)企(qi)业(ye)要按照当地人社部门的规定(ding),在指定(ding)的商(shang)业(ye)银(yin)行(xing)账(zhang)户中存(cun)(cun)(cun)储工(gong)(gong)(gong)资(zi)(zi)保(bao)(bao)(bao)证金,专(zhuan)项用(yong)于支(zhi)付(fu)为(wei)所承包(bao)工(gong)(gong)(gong)程提(ti)供劳(lao)动(dong)的农民工(gong)(gong)(gong)被拖(tuo)欠(qian)的工(gong)(gong)(gong)资(zi)(zi)。工(gong)(gong)(gong)资(zi)(zi)保(bao)(bao)(bao)证金实(shi)行(xing)差异化管(guan)理,对三(san)年内未发(fa)生工(gong)(gong)(gong)资(zi)(zi)拖(tuo)欠(qian)的企(qi)业(ye)实(shi)行(xing)免交(jiao),对发(fa)生工(gong)(gong)(gong)资(zi)(zi)拖(tuo)欠(qian)的企(qi)业(ye)适当提(ti)高(gao)存(cun)(cun)(cun)储比例。推行(xing)工(gong)(gong)(gong)资(zi)(zi)保(bao)(bao)(bao)证金以银(yin)行(xing)保(bao)(bao)(bao)函(han)、保(bao)(bao)(bao)证保(bao)(bao)(bao)险(xian)方式缴(jiao)纳。施工(gong)(gong)(gong)总承包(bao)企(qi)业(ye)未按规定(ding)存(cun)(cun)(cun)储工(gong)(gong)(gong)资(zi)(zi)保(bao)(bao)(bao)证金或者未提(ti)供金融机(ji)构保(bao)(bao)(bao)函(han)的,一经查实(shi),责令限期(qi)改正,记录不良(liang)信用(yong):逾(yu)期不改正的,按管理(li)权限(xian)依法依规给(ji)予施工总承包企业限(xian)制承接新工程、降低资质等(deng)(deng)级、吊销资质证书等(deng)(deng)处罚。

()先行垫付(fu)(fu)和清(qing)偿制度。建(jian)设(she)(she)(she)单(dan)位对(dui)农(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)资支(zhi)付(fu)(fu)承担(dan)首要责任,施工(gong)(gong)(gong)(gong)(gong)(gong)总承包企业对(dui)农(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)资支(zhi)付(fu)(fu)承担(dan)主体(ti)(ti)责任。建(jian)设(she)(she)(she)单(dan)位未按照(zhao)合同约(yue)定(ding)足额、按时(shi)拨付(fu)(fu)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)进度款(kuan)导致农(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)资拖(tuo)欠的(de),由(you)建(jian)设(she)(she)(she)单(dan)位以未结清(qing)的(de)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)为(wei)限(xian)先行垫付(fu)(fu)被拖(tuo)欠的(de)农(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)资。对(dui)拒不(bu)垫付(fu)(fu)的(de)建(jian)设(she)(she)(she)单(dan)位,记录不(bu)良信(xin)用;涉及政(zheng)府投资(zi)项目的,记录不良信(xin)用,及时移交人(ren)力(li)资(zi)源社(she)会(hui)保障部门和其他(ta)有(you)关(guan)部门,按照《保障农(nong)民(min)工(gong)工(gong)资(zi)支(zhi)付(fu)条例(li)》及相关(guan)法律、法规规定处理(li)。建设单位(wei)已按合(he)同约定足额(e)、按时拨付(fu)工(gong)程进度款、结算款,但施工(gong)总承(cheng)(cheng)包(bao)企业未及时代(dai)发,导致农(nong)民(min)工(gong)工(gong)资(zi)拖欠的,由施工(gong)总承(cheng)(cheng)包(bao)企业清(qing)偿(chang);涉及(ji)分包企业(ye)拖(tuo)欠农民(min)工(gong)(gong)工(gong)(gong)资、项目转包拖(tuo)欠农民(min)工(gong)(gong)工(gong)(gong)资的,由施工(gong)(gong)总承包企业(ye)先行清偿,再依法进(jin)行追偿。对拒(ju)不(bu)先行清偿的施工(gong)(gong)总承包企业(ye),一(yi)经查实,责令限期改正,记录不(bu)良信用:逾(yu)期不(bu)改正的,按管理(li)权(quan)限依法(fa)依规给予施工(gong)总承(cheng)包(bao)企业(ye)限制承(cheng)接新工(gong)程(cheng)、降低资质等级、吊销资质证书等处罚。

()维(wei)权(quan)公示(shi)制(zhi)度(du)。施工(gong)总承包企(qi)业(ye)要在施工(gong)现(xian)场醒(xing)目位(wei)置(zhi)设立维(wei)权(quan)信息告示(shi)牌,明示(shi)规定事项,并(bing)每月公示(shi)农民工(gong)签字确认(ren)的工(gong)资支付表。对(dui)违反维(wei)权(quan)公示(shi)制(zhi)度(du)的施工(gong)总承包企(qi)业(ye),一经查实(shi),责令限期改正,记录(lu)不良信用(yong);逾期(qi)不改正的,按规定给予罚(fa)款处罚(fa)。

二、分级建立农民工(gong)工(gong)资支(zhi)付(fu)异常名录

省、市、县(市、区)住房城乡建设(she)主(zhu)管部门要分级建立建设(she)单位、施工企业农(nong)民工工资支付异常(chang)名录,报送同级人力资源社会保障部门备案。

()分(fen)级制定(ding)范围

1.县级名录。施(shi)工(gong)总承包企业或分包企业拖欠农民工(gong)工(gong)资(zi)数额50万(wan)元以下(50万元(yuan))的,或拖欠、无故克扣(kou)农民工工资(zi)涉及(ji)人数在10人以内(含(han)10)的,由(you)县(市(shi)、区)住(zhu)房城乡(xiang)建设主管部门责令限(xian)期改正:逾(yu)期拒不改正的(de),列(lie)入(ru)县级(ji)农(nong)民(min)工(gong)(gong)工(gong)(gong)资(zi)(zi)支(zhi)付异常(chang)(chang)名录。因相应(ying)建设项目(mu)拖(tuo)欠工(gong)(gong)程(cheng)款(kuan)导(dao)致(zhi)施工(gong)(gong)企业被列(lie)入(ru)农(nong)民(min)工(gong)(gong)工(gong)(gong)资(zi)(zi)支(zhi)付异常(chang)(chang)名录的(de)建设单位,一(yi)并列(lie)入(ru)县级(ji)农(nong)民(min)工(gong)(gong)工(gong)(gong)资(zi)(zi)支(zhi)付异常(chang)(chang)名录。

2.市级名录。施工总承包企业或分包企业拖欠农民工工资(zi)50万元以上,200万(wan)元(yuan)(200万元(yuan))以下的,或(huo)拖欠、无(wu)故克扣(kou)农民工(gong)工(gong)资涉及人员在10人以上,50(50)以下的,或拖欠、无故(gu)克扣农民工工资情节严(yan)重,1年(nian)内同(tong)一企业(ye)2次(ci)被县(市、区)住房城乡建(jian)设(she)主(zhu)管部门列(lie)(lie)入农民工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)支(zhi)(zhi)付异(yi)常名录(lu),由市住房城乡建(jian)设(she)主(zhu)管部门列(lie)(lie)入市级(ji)(ji)农民工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)支(zhi)(zhi)付异(yi)常名录(lu)。因相应建(jian)设(she)项目拖欠工(gong)(gong)(gong)程款导致(zhi)施工(gong)(gong)(gong)企业列(lie)(lie)入市级(ji)(ji)农民工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)支(zhi)(zhi)付异(yi)常名录(lu)的(de)建(jian)设(she)单(dan)位,一(yi)并(bing)列(lie)(lie)入市级(ji)(ji)农民工(gong)(gong)(gong)工(gong)(gong)(gong)资(zi)支(zhi)(zhi)付异(yi)常名录(lu)。

3.省级名(ming)录。施工(gong)总承包企(qi)业(ye)或分(fen)包企(qi)业(ye)拖欠农民(min)工(gong)工(gong)资200万元以上(shang),或拖(tuo)欠、无故克(ke)扣(kou)农民工工资涉及人(ren)员在(zai)50人以(yi)上(shang),或拖欠、克扣(kou)农民(min)工(gong)工(gong)资情节严重(zhong),1年内同一企(qi)业(ye)2次(ci)被列入市(shi)级(ji)(ji)农(nong)民工(gong)(gong)工(gong)(gong)资支(zhi)付(fu)(fu)(fu)异常名(ming)录的,由省(sheng)住房城乡建(jian)设厅列入省(sheng)级(ji)(ji)农(nong)民工(gong)(gong)工(gong)(gong)资支(zhi)付(fu)(fu)(fu)异常名(ming)录。因相应(ying)项(xiang)目拖(tuo)欠工(gong)(gong)程款导(dao)致施工(gong)(gong)企业被列入省(sheng)级(ji)(ji)农(nong)民工(gong)(gong)工(gong)(gong)资支(zhi)付(fu)(fu)(fu)异常名(ming)录的建(jian)设单(dan)位,一并列入省(sheng)级(ji)(ji)农(nong)民工(gong)(gong)工(gong)(gong)资支(zhi)付(fu)(fu)(fu)异常名(ming)录(lu)。

(二(er))严格(ge)惩戒措施(shi)

通过媒体向(xiang)社会公开发布列(lie)(lie)入农民工(gong)(gong)工(gong)(gong)资支(zhi)付异(yi)常名(ming)(ming)(ming)(ming)录的建(jian)设单(dan)位、施(shi)工(gong)(gong)企(qi)业(ye)(ye)名(ming)(ming)(ming)(ming)单(dan)。对直接发包(bao)的项(xiang)目(mu),建(jian)设单(dan)位不(bu)得(de)将工(gong)(gong)程(cheng)项(xiang)目(mu)发包(bao)给列(lie)(lie)入名(ming)(ming)(ming)(ming)录的施(shi)工(gong)(gong)企(qi)业(ye)(ye)。施(shi)工(gong)(gong)总承(cheng)包(bao)企(qi)业(ye)(ye)不(bu)得(de)将工(gong)(gong)程(cheng)分包(bao)给被(bei)列(lie)(lie)入名(ming)(ming)(ming)(ming)录的专(zhuan)业(ye)(ye)承(cheng)包(bao)企(qi)业(ye)(ye)。列(lie)(lie)入名(ming)(ming)(ming)(ming)录的施(shi)工(gong)(gong)企(qi)业(ye)(ye),不(bu)得(de)参加安徽省(sheng)优(you)秀建(jian)筑业(ye)(ye)企(qi)业(ye)(ye)评选;列入名录的建设单位、施(shi)工企(qi)业,不得申报(bao)各类优质工程(cheng);列入名录(lu)的政府投(tou)资项目建设(she)单(dan)位,移交(jiao)人(ren)力资源社会保障部门和(he)其(qi)他有关部门,按照《保障农民(min)工(gong)工(gong)资支(zhi)付条例》及相(xiang)关法律、法规规定处(chu)理。被列入省(sheng)级(ji)农民(min)工(gong)工(gong)资支(zhi)付异常名录(lu)的施(shi)工(gong)企业(ye),限制其(qi)参加全省(sheng)范围(wei)内(nei)房(fang)建和(he)市政工(gong)程建设(she)项目投(tou)标;列入市(shi)(shi)、县级异常名录的施工企(qi)业,限制其参加本行政区域内房建(jian)和市(shi)(shi)政建(jian)设项目投标。

()规范列入(ru)程序

各市(shi)、县(市、区)住房城乡建设(she)主(zhu)管部门根据(ju)日常巡查、专项(xiang)检查、举报(bao)投诉、受理信(xin)访等情(qing)况,提出列入农民工工资(zi)支付异常名录的建设(she)单位(wei)、施(shi)工企业名单和基本(ben)事实,在(zai)本(ben)部门网站公示;在受理和处理建(jian)设(she)单(dan)(dan)位、施(shi)工企业陈述、局(ju)长(zhang)办公会审议通过后,在本部门网站向社会公布,并书面通知被列入农(nong)民工工资支(zhi)付(fu)异常名录的(de)建(jian)设(she)单(dan)(dan)位、施(shi)工企业;属(shu)政(zheng)府投资项目建(jian)设(she)单(dan)位的,应告知(zhi)其上一级政(zheng)府及(ji)主管(guan)部门。书面通知(zhi)须载明列入事实、认定依据、惩戒(jie)措施、限制(zhi)移出期限及(ji)其他应告知(zhi)的事项。市、县(市、区)在列入结束后7个工作日(ri)内报上一级(ji)住房城乡建设主(zhu)管(guan)部门(men)备案。省级(ji)农民工工资支付异(yi)常名录列入程序另行规定。

()建(jian)立(li)限制移出制度

列(lie)入(ru)农民工(gong)工(gong)资支(zhi)付异常名录的建设单位(wei)、施工(gong)企业限制(zhi)移出(chu)(chu)期限从列(lie)入(ru)之日起计算(suan),限制(zhi)移出(chu)(chu)期为半年(nian)。限制(zhi)移出(chu)(chu)期内未发生违反(fan)《保障农民工(gong)工(gong)资支(zhi)付条例》相关规(gui)定的,由列(lie)入(ru)部(bu)门(men)给予移出(chu)(chu),并由列(lie)入(ru)部(bu)门(men)出(chu)(chu)具移出(chu)(chu)凭证,并进(jin)行(xing)公布(bu)。自限制(zhi)移出(chu)(chu)期满之日起2年(nian)内(nei)再次被列入农民(min)工工资支(zhi)付异(yi)常名录的(de)建设单位、施工企业,限制移出期限延(yan)长为1年。

三、强(qiang)化源头(tou)管控

()严格建设(she)资金(jin)审核。对新(xin)建房建和(he)市政工程(cheng)项目,住(zhu)房城乡建设(she)主(zhu)管部门要核实(shi)经批(pi)准的建设(she)规模和(he)资金(jin)落(luo)实(shi)情况,对建设(she)资金(jin)不落(luo)实(shi)的一律不予办理施工许可、质量(liang)安全报监手续;对有拖欠工程(cheng)款记(ji)录的建(jian)(jian)设(she)单位(wei),要从严审查(cha)。对建(jian)(jian)设(she)单位(wei)提供资金虚假证明(ming)的,一经查(cha)实(shi),撤销施(shi)工许(xu)可证,责令限期整改(gai),在(zai)整改(gai)期内(nei)不再核发其申请的其他(ta)建(jian)(jian)设(she)项目(mu)施(shi)工许(xu)可证,并通过本部门网(wang)站向社会公布(bu)。

(二(er))严格工(gong)程价款结算。实行(xing)工(gong)程预(yu)(yu)付款制度,建设单位(wei)拨付的工(gong)程预(yu)(yu)付款应不低于合同(tong)总价(扣除暂列金额)10%。在具(ju)备施(shi)工条件的前提下,建设单位应在合同(tong)签订后一(yi)个(ge)月(yue)内或不迟于约定的开(kai)工日期(qi)前7天内(nei)预付工程款(kuan);推行施工过程结算,发(fa)承包双方应按照(zhao)合同约定的(de)时间、程序和方法,根据工程计(ji)量(liang)结果,办理期(qi)中价款结算,支付进(jin)度款,且(qie)支付的(de)进(jin)度款不低于(yu)期(qi)中结算价款的(de)80%。建(jian)设单(dan)位不(bu)得以未竣(jun)工验收、未完成审计为由拖(tuo)欠工程款(kuan),验收合格的(de)分部工程必须(xu)在6个(ge)月(yue)内完成结算并支付,否则视为故意拖(tuo)欠工(gong)程款。对违反规定的建(jian)设单位,记录不良信用(yong);涉(she)及(ji)政府投(tou)资(zi)项(xiang)目(mu)的,移(yi)交人力资(zi)源社会(hui)保(bao)障(zhang)部门和(he)其(qi)他有关部门,按照《保(bao)障(zhang)农民工(gong)工(gong)资(zi)支付条例》及(ji)相关法律、法规(gui)(gui)规(gui)(gui)定(ding)处理。

(三(san))严(yan)格(ge)垫资(zi)(zi)建(jian)(jian)设(she)(she)管(guan)控(kong)。禁止各类政府投(tou)资(zi)(zi)项(xiang)目(mu)使(shi)用(yong)施工企业垫资(zi)(zi)承包(bao)(bao)方式组织建(jian)(jian)设(she)(she),对(dui)政府投(tou)资(zi)(zi)项(xiang)目(mu)实(shi)行垫资(zi)(zi)建(jian)(jian)设(she)(she)的建(jian)(jian)设(she)(she)单位,一经查实(shi),记录不(bu)良信用(yong),约(yue)谈建(jian)(jian)设(she)(she)单位负(fu)责人(ren)。对(dui)房(fang)地产开发等(deng)社(she)会投(tou)资(zi)(zi)项(xiang)目(mu),要求施工单位垫资(zi)(zi)的,必须在(zai)招(zhao)标文件(jian)和施工合同中明(ming)确(que)约(yue)定(ding)垫资(zi)(zi)数额、计息(xi)方式和偿(chang)还期(qi)限,违反约(yue)定(ding)的,记录不(bu)良信用(yong)。对(dui)社(she)会投(tou)资(zi)(zi)项(xiang)目(mu)垫资(zi)(zi)承包(bao)(bao)的施工企业,不(bu)得再要求分包(bao)(bao)企业垫资(zi)(zi)施工,否则,记录不(bu)良信用(yong)。

()严格实行(xing)工程(cheng)担保(bao)。工程(cheng)建(jian)设领(ling)域各类保(bao)证(zheng)(zheng)金能够通(tong)过保(bao)函、保(bao)证(zheng)(zheng)保(bao)险(xian)等方式提供(gong)的,相关部门(men)和(he)建(jian)设单(dan)位一律不得拒绝。房建(jian)和(he)市政工程(cheng)建(jian)设项目实行(xing)工程(cheng)款支付担保(bao)制度,建(jian)设单(dan)位应在取得施工许可证(zheng)(zheng)3个月内向施工企业提供施工合(he)同额8%-10%的工程款支付(fu)担(dan)保。工程款支付(fu)担(dan)保可以采用银行保函、保证保险、第三方担(dan)保等方式。对不(bu)能(neng)提供(gong)工程款支付(fu)担(dan)保书的建设(she)(she)单位,视为建设(she)(she)资(zi)金不(bu)落实,住房城乡建设(she)(she)主管部门应责(ze)令限(xian)期改正;逾期不改(gai)正(zheng)的,责令项(xiang)目停(ting)工,并(bing)依法给予罚款(kuan)处罚。

(五(wu))严格(ge)规范(fan)发(fa)承(cheng)包(bao)行为。房建和(he)市政(zheng)工程建设(she)工程发(fa)承(cheng)包(bao)合同必须依据《安徽省(sheng)房屋建筑和(he)市政(zheng)基础设(she)施(shi)工程项目(mu)招标(biao)文件示(shi)范(fan)文本》。严禁围标(biao)串标(biao)、转包(bao)挂靠、违法分包(bao)、出借资(zi)质、违规收取项目(mu)管(guan)理费、订立阴阳合同(tong),一经查实,依法严肃处(chu)理。施工现场项目部管理人员(yuan)必须全部由总承(cheng)包企业派出(chu),并切实履行相应管理职责。总承(cheng)包企业不得随意变(bian)更投标文件(jian)承(cheng)诺的关键岗位人员(yuan);需要(yao)变更的,应(ying)经建设单位主要(yao)负责(ze)人签字同(tong)意(yi)、加盖公(gong)(gong)章,书面(mian)报项目(mu)所在地住房(fang)城(cheng)乡建设、公(gong)(gong)共资源交(jiao)易监(jian)管(guan)部门,其(qi)变更信息(xi)同(tong)步在建筑(zhu)市场监(jian)管(guan)公(gong)(gong)共服(fu)务平台(tai)、公(gong)(gong)共资源交(jiao)易管(guan)理平台(tai)公(gong)(gong)开(kai)。

(六(liu))严格质量(liang)保(bao)证金管理。房建和(he)市政建设工(gong)程项目建设单位必须在(zai)招标文件中(zhong)(zhong)明确质量(liang)保(bao)证金预留及返还的(de)比(bi)例、期限(xian)和(he)方式,并在(zai)施工(gong)合同中(zhong)(zhong)与施工(gong)企业约定;双(shuang)方约定的缺陷责任期最(zui)长不得(de)超过24个月。缺陷责任(ren)期到期后,建设(she)单位应(ying)将质量(liang)保证金在扣(kou)除因施(shi)工(gong)(gong)(gong)企业(ye)责任(ren)造成缺陷的(de)鉴定(ding)(ding)及(ji)相(xiang)应(ying)维修费用后全部返还施(shi)工(gong)(gong)(gong)企业(ye)。经竣工(gong)(gong)(gong)验收合格的(de)工(gong)(gong)(gong)程(cheng)项目,任(ren)何单位不得以工(gong)(gong)(gong)程(cheng)存在质量(liang)问(wen)题为由(you)单方面扣(kou)押应(ying)按(an)合同(tong)约定(ding)(ding)拨付的(de)工(gong)(gong)(gong)程(cheng)进度款(kuan)或(huo)工(gong)(gong)(gong)程(cheng)结算款(kuan)。对违(wei)反规定(ding)(ding)的(de)建设(she)单位,记录不良信用;涉及政(zheng)府投(tou)资项目(mu)的建设单位,除依法(fa)承担责任外,及时移交人力(li)资源社会保障(zhang)部(bu)门和其他有关部(bu)门,按照《保障(zhang)农民工工资支付条例(li)》及相关法(fa)律(lv)、法(fa)规规定(ding)处理。

四、加强(qiang)组织(zhi)实施

(一(yi))压实责任。各(ge)市(shi)、县(市、区)住房城乡建设主管部门主要负责(ze)同志(zhi)为本地(di)(di)区保(bao)障(zhang)建筑行(xing)业农(nong)民(min)工(gong)工(gong)资支付工(gong)作的第一责(ze)任(ren)人,要落(luo)实行(xing)业监管责(ze)任(ren)和(he)领导班(ban)子(zi)成员包(bao)保(bao)制(zhi)度,加强(qiang)研(yan)判,统筹调(diao)度,靠(kao)前指(zhi)挥,及(ji)时协调(diao)研(yan)究解决问题,确保(bao)各项农(nong)民(min)工(gong)工(gong)资支付保(bao)障(zhang)制(zhi)度落(luo)地(di)(di)见效。多措(cuo)并举,压实建设单位首要责(ze)任(ren)和(he)总承包(bao)企业主体责(ze)任(ren),建立(li)和(he)完善(shan)根治欠薪长效机制(zhi)。

()制定(ding)细则。各市、县(市、区)住房(fang)(fang)城乡建设主管部(bu)门(men)要会同公共资源交易、房(fang)(fang)地产管理、重点工程管理、城管执法等部(bu)门(men),按照(zhao)本通知精神,制(zhi)定(ding)印发(fa)本地区(qu)保障(zhang)建筑行(xing)业(ye)农民(min)工工资支(zhi)付(fu)实施(shi)细则,细化工作举措(cuo),分类(lei)细化具体指标,制(zhi)定(ding)行(xing)政处理、处罚操作标准,压实推进责任,明(ming)确保障(zhang)措(cuo)施(shi)。各(ge)市实施(shi)细则于20227月底前报送我厅建筑市场监管处(建设工(gong)程(cheng)招标监督管(guan)理处(chu))

()完善系(xi)统(tong)。各市住房城乡建设主管(guan)部门要依托信用管(guan)理系(xi)统(tong),在2022年(nian)7月(yue)20日前完成增设(she)(she)建(jian)设(she)(she)单位信用评价功能,及时记录、归集、共享建(jian)设(she)(she)单位信用评价结果;完成建设单位、施工企业农(nong)民工工资支付异常名录库设立、权限(xian)配(pei)备、信(xin)息共(gong)享、事项(xiang)查(cha)询等功能开发(fa)工作。

()加强(qiang)督查。各市住房城(cheng)乡(xiang)建设、公(gong)共(gong)资(zi)源(yuan)交易(yi)、房地(di)产管(guan)理、重点工程管(guan)理、城(cheng)市管(guan)理等部门(men)要加强(qiang)部门(men)联动,指导、督促所辖(xia)县(市、区)全面落实(shi)保障(zhang)农民工工资支(zhi)付各项制度(du),建立根(gen)治欠(qian)薪(xin)长(zhang)效机制,用好信用惩(cheng)戒,严格规(gui)范执法,发(fa)现问题,及(ji)时解决。我厅将适时对各市(shi)贯(guan)彻落实(shi)情况(kuang)开展督导(dao)督查,对领导(dao)重视不够、制度(du)落实(shi)不力、推进(jin)力度(du)不大(da)、欠(qian)薪(xin)欠(qian)款频发(fa)高(gao)发(fa)等问题突(tu)出的地区,采取约(yue)谈(tan)、通(tong)报、限期整改等措(cuo)施。

本文自20227月(yue)1日起施行,有效期3年。
